The costs of responding to ship-sourced oil spills in Australian waters are met by those responsible for the spill through various domestic and international arrangements.
This calculator displays the limit of liability for oil pollution damage by oil carrying ships under the
International Convention on Civil Liability for Oil Pollution Damage 1992 (CLC92)
and the
International Convention on Civil Liability for Bunker Oil Pollution Damage 2001 (Bunkers Convention).
For oil tankers, the calculator also provides an estimate in Australian dollars of the maximum compensation potentially available through the International Oil Pollution Compensation (IOPC) Funds - the 1992 Fund and the Supplementary Fund.
Under Australian law, the
Convention on Limitation of Liability for Maritime Claims 1976 as amended by the protocol of 1996 (LLMC96) defines
the shipowner's limit of liability under the Bunkers Convention. The calculator uses the limits in force under Australian law from 8 June 2015.
